Keep Alert has compiled some exclusive statistics on the UDRP procedures (Uniform Domain Name Dispute Resolution Policy) processed by the WIPO in 2012 filed by French complainants.

In 2012, French Complainants obtained 245 UDRP decisions, which represented 11% of all UDRPs filed in 2012.

Success rate:
  • French complainants success rate in 2012 was 96%
  • the overall success rate in 2012 was 91%
Outcome of the UDRP decisions:
  • 84% of domain names were transferred to the Complainants
  • 16% of domain names were deleted
Types of infringements:
  • 71% of domain names contained the Complainant’s trademark
  • 21% of domain names were identical to the Complainant’s trademark
  • 8% of domain names were visually or phonetically close to the Complainant’s trademark
Frequently appended words to domain names:
  • 11 times: BAG, HOTEL and ONLINE
  • 9 times: SHOP
  • 4 times: OUTLET, PARIS and SALE
  • 3 times: BIJOU, BUY, CATALOGUE, CHEAP, CN, REPLICA, SERVICE, WALLET and WATCH
Use of the domain names before the complaint was filed:
  • 38,5% of domains resolved to a parking page
  • 25,5 of domains resolved to active websites
  • 17,4% of domains resolved to websites offering counterfeit items
  • 3,5% of domains redirected to other websites
  • 3% of domains were used for phishing, pornsquatting, waiting page…
Use of the domain names after the UDRP decision:
  • 47% of domains resolve to a waiting page
  • 25% of domains do not resolve (no website)
  • 23,5 of domains redirect to the Complainants’ websites
  • 2,5 of domains resolve to a parking page
  • 2% of domains resolve to some harmful content
Defendant’s countries of origin:
  • China: 25%
  • United States: 15%
  • France: 12%
  • Australia: 10%
  • Russia: 3%
